Title: Law making at the municipal level in the Slovak Republic

Brief characteristics of the project:

The project examined the right of municipalities to issue general binding regulations in matters of territorial self-government and to ensure the tasks arising for the self-government from the law as one of the rights granted by the Constitution of the Slovak Republic itself forming part of the right of the municipality to self-government. Within the framework of the project results, the solvers noted a number of problems both in the constitutional law and in the application level. Supervisory authorities, and consequently also general courts, approach the issue of municipal standard-setting in a restrictive manner and this approach raises legitimate questions about the meaningfulness of the concept of self-government general binding regulations of municipalities under Article 68 of the Constitution of the Slovak Republic. Nor can satisfaction be expressed with the exercise of norm-making power by municipalities, when they often exercise it in contravention of the Constitution and the legal order of the Slovak Republic due to their lack of expertise and knowledge of the law.

Title: Competences of municipal self-government and state participation in their execution

Brief characteristics of the project:

The most important results are summarized in the monograph "Competences of municipalities in legal theory and jurisprudence". It focuses on the definition of the principles of territorial self-government, especially those that find their expression in the exercise of the municipality's own competences (in particular the principle of subsidiarity, relative independence and the principle of adequacy of own resources). Attention is paid to the problematic issues of competences in the protection of the peace in the municipality, in the imposition and administration of local taxes, and in the social and legal field, which is highly problematic in practice. Within the analysed areas, the authors define the limits within which the state should and can move when intervening in the legal regulation of municipal competences as well as in the legal-applicational level of their implementation. Based on the decision-making practice of general courts and the Constitutional Court of the Slovak Republic, the authors also analyse the attitude of the judicial power towards the autonomy of municipalities and formulate the basic general starting points for the future legal regulation of municipal competences.

Title: Possibilities of using means of alternative dispute resolution (ADR) in public administration.

Brief description of the project:

The topic of the project is the investigation of the possibilities of using mediation and other means of ADR in legal decision-making processes implemented by the public administration. These are standard-setting processes, as well as law-enforcement processes, implemented within selected types of administrative proceedings and in tax proceedings. The examination of legal limits will be supplemented by the examination of public policy assumptions and impacts, as well as the possibility of their financial coverage with public financial resources.
