Sekundárny - dosiahnutie takého výkladu a používania Charty, ktorý bude zodpovedať zámerom, pre ktoré sa Charta stala záväzným právnym predpisom aj pre členské štáty EÚ. Terciárny - dosiahnutie takého stavu výkladu a používania Charty, ktorý vylúči prípadnú zodpovednosť štátu za porušovanie práva Únie, ktoré sa postihuje v konaní pred SD. |
VEGA 1/0709/16 Place and Significance of Regional Judicial Bodies Context of the Contemporary Regionalism, 01/2016-12/2018, co-worker It is prevailing trend within contemporary regionalism which became geographically extensive, that within the structure of regional organizations and looser international cooperative institutions (with some exceptions such as ASEAN), the judicial organ is corporated as the part of their peaceful dispute settlement systems (Court of Justice of the EU, EFTA Court, BENELUX Court of Justice, European Court of Human Rights, Interamerican Court of Human Rights, African Court on Human and Peoples´ Rights, ECOWAS Community Court of Justice etc.). Creation of such tribunals is part of the process of judicialization of general international law, which is a phenomenon of the last 25 years of past century and overlaps to recent time. The aim of this project is to bring an analysis of a place and significance of regional judicial bodies within contemporary institutional regionalism. |
APVV-18-0421 The European Public Prosecutor´s Office in Connections of the Constitutional Order of the Slovak Republic as Strengthening of the European Integration through Law, 07/2019- 06/2023, principal investigator By the Council Regulation 2017/1939 of 12 October 2017 which entered into force on 20 November 2017 the European Public Prosecutor's Office was established as a new body in the institutional system of the European Union. Although its establishment is envisaged by the primary law of the European Union, the first attempts failed because of the unanimity requirement in the Council since not all the Member States have supported its establishment. This was the reason why some of the Member States decided to use the mechanism of the enhanced cooperation in which there are in relation to the European Public Prosecutor's Office currently participating 22 Member States including the Slovak Republic. European Public Prosecutor's Office is a significant, even groundbreaking element of the integration in relation to the Member States. Until now, the criminal policy and repression have been applied exclusively on the national level by the Member States' bodies without their practice being controlled, replaced or applied in parallel by any European Union body. The competences of the European Public Prosecutor's Office change this state in a significant way since there are shared competences partially established in the area of freedom, security and justice. |
