doc. JUDr. Radomír Jakab, PhD. accomplished his university study in the study field of law at Faculty of Law of University of P. J. Safarik in Kosice in 2004. In 2005 he completed postgraduate study in the study field of commercial law at the same faculty. From 2004 he was PhD. – student in the study field of administrative law, while in 2010 he successfully completed this study by defending his dissertation thesis at the Faculty of Law of Commenius University in Bratislava. In 2016 he has sucessfully finished habilitation proceedings at the Faculty of Law of Commenius University in Bratislava and he was given the title Associated Professor (docent) in the study field of administrative law. From 2004 to 2009 he worked as an in-house lawyer in the business companies Vychodoslovenska energetika a.s. and Vychodoslovenska distribucna, a.s., being part of Innogy Group. In 2010 he worked at the Faculty of Public administration of the University of P. J. Safarik in Kosice as scientific worker. From 2011 he works at the Faculty of Law of the University of P. J. Safarik in Kosice as Assistant Professor, and from 2016 as Associated Proffesor. Today he also has a position of vice-dean for scientific research, PhD. study and further eduction at the Faculty of Law of the University of P. J. Safarik in Kosice. From 2012 he is independent attorney at law. And from 2019 he is only owner and managing director in the company Advokátska kancelária doc. JUDr. Radomír Jakab, PhD., s.r.o. doc. JUDr. Radomír Jakab, PhD. has successfully passed BAR examination, moreover he has accomplished professional course of mediators (out-of-court negotiator), EU cartel law course, and soft skills development trainings. He can fluently speak english and german. The main focus of his professional interest is mainly administrative law (namely asministrative procedural law, european administrative law, municipality law, energy law, and public procurement law).

A trans-territorial administrative act is a special category of administrative acts, the essence of which lies in the fact that it also has its effects on the territory of a state other than the issuing state, i. has extraterritorial effects. It has a specific place, especially in the European Union. The aim of this project is a scientific examination of this type of administrative acts, defining its characteristics and its effects, examining the possibilities of procedural defense before its effects by the state concerned, or assessing the possibility of unifying the action of European Union member states. acts.

Criminal law is a branch of public law. The fact that criminal law is a branch of public law heralds the relationships between entities, acting in its legislative basis for governing the principle of subordination, where the superior body is usually a public authority. Applicational, legislative and legal problems of recent years, however, point to the fact that compliance with the principle of legality is not in practical terms the criminal law is always on the constitutional acceptable level. The legislature in the exercise of their activities often ignores the need for respect of value (axiological) the requirements of criminal law. The proportionality of a number of criminal laws have in terms of their constitutional conformity assessed to the Constitutional Court of the Slovak Republic, at application level, on the contrary, there are inconsistencies modify some of the procedural rights of the individual ,,or subordinate "subjects of criminal proceedings. Finally, it is necessary to reflect the lack of socalled level of extra-legal guarantees of legality that represent organizational-technical prerequisite for fulfilling the purpose of the criminal law in modern democratic rule of law. Research team believes that some of the legislative and criminal law application problems of the 21st century can be eliminated by ,,private intervention " VV 2016 Základný výskum APVV-16-0362 Akronym: PTPHPKOTA 08.06.2017 09:13 Strana/Page: 2 in some of its institutes. For these reasons, the research team is planning a comprehensive way to deal with the privatization of criminal law in terms of substantive, procedural, organizational-technical and criminological aspects. Respecting the principle of legality as immanent rule of law is necessary to examine the legislative aspects of the privatization and the application of criminal law, not only within the legal but also within the constitutional limits and possibilities of transnational privatization of criminal law in the current Slovak Republic.


APVV reg. no.20-0076 - Waste and construction - modeling the effectiveness of alternative options for cooperation between administrative authorities, 07/2021-06/2024, co-worker


In Slovakia, the management of municipal waste and small construction waste , which is generated in the municipality, the municipality is responsible according to the Act No. 369/1990 Coll. as amended. However, in the waste management, the county authorities also exercise their competencies.As for competencies in the building sector , each municipality is in accordance with the Act No. 50/1976 Coll. on Spatial Planning and Building Regulations (Building Act) as amended, a building authority, while the activity of the Building Authority is a delegated/ transferred performance of state administration.The proposed procedure for public administration functioning in the Slovak Republic in the waste and construction sector, is to model effective cooperation between administrative bodies of state administration (county offices) and self-government (municipalities). The proposed procedures for the project will be implemented based on data on individual municipalities' performance in the field of waste and building regulations. More effective cooperation between the state administration and local government in waste management competencies will be modeled. In the construction sector, we will model the performance of these competencies provided by county authorities (CO Model). We will perform modeling on data from municipalities and county offices of the Nitra and Košice regions. In the waste sector, we model more effective cooperation between state administration and self-government. In the case of building competencies, which according to the Program Statement of the Government of the Slovak Republic for 2020-2024, are to be transferred from municipal building offices (Model S) to county offices (CO Model), we assume that the CO Model will be more effective than the current model based on municipalities, e.g. performance of construction/ building competencies by joint building authorities.

VEGA 1/0187/22 - Extraterritorial effects of foreign administrative acts in the European union, 01/2022-12/2024, principal investigator


One of the instruments for ensuring the freedom of movement of goods, services, persons and capital within the European Union is the enabling of free movement of decisions within the European area. In relation to court decisions, legal regulation has been harmonized in recent years. However, this cannot be stated in relation to administrative decisions. In some cases, administrative decisions are subject to the regime of recognition according to the national legislation of the host state, in some cases to recognition according to the harmonized regulations of the European Union. At the same time, there is a group of decisions having a transterritorial nature, which have direct effects on the territory of another member state without the need for their recognition. Therefore, the goal of the proposed project is the scientific investigation of the extraterritorial impact of administrative decisions of the European Union member states on the territory of other member states in order to assess the possibilities of harmonizing legal regulation within the European Union member states.
